Sales Terms

Read our sales and delivery terms to understand your rights and obligations when purchasing our products. We ensure clear and fair conditions for all our customers, with a focus on transparency and reliability.

These terms apply unless otherwise agreed in writing between the Seller and the Buyer.

1. Prices

The offered goods are delivered to the Buyer's address at the agreed and accepted price as per the offer.

In addition, the Buyer will be invoiced for shipping and packaging costs from the Seller to the Buyer's address according to the Seller's shipping rates.

2. Offers

All offers are provided in Norwegian kroner unless otherwise agreed.

All offers must be confirmed in writing by the Buyer to be binding for the Seller.

Offers are valid for a period of 30 days from the date of the offer unless otherwise specified.

For repair offers, the Buyer must confirm in writing within 5 business days whether the offered repairs should be carried out. If confirmation is not received, the equipment will be returned to the Buyer at their expense and risk, and the Buyer will be charged NOK 3,000 for labor, storage fees, etc. The Buyer will also be charged for shipping.

If the Buyer does not wish to proceed with the repair, a fee of NOK 3,000 will be charged for completed work.

If the Buyer chooses to arrange return transport but does not collect the goods within 6 business days, the Seller has the right to arrange transport and charge the Buyer according to applicable rates.

3. Returns and Cancellations

If canceled within 48 hours after the Buyer has accepted the Seller's offer in writing, the Buyer will be charged a cancellation fee of 66% of the order amount.

Cancellations after the goods have been received by the Buyer are not accepted unless otherwise required by Norwegian law.

4. Defects and Claims

The Buyer cannot claim defects as grounds for contract termination unless the Seller has had three opportunities to rectify the defect.

Delays do not entitle the Buyer to cancel the purchase.

5. Delivery

Delivery is made using the Seller's standard distribution system unless otherwise agreed and will be invoiced according to the Seller's shipping rates.

6. Delivery Time

The Seller will provide the Buyer with written information about the expected delivery date. The delivery date is indicative.

7. Consequential Damages

The Seller is not responsible for any consequential damages. The Seller's liability is limited to repair or replacement of the goods.

8. Buyer's Inspection Obligation

The Buyer must inspect received goods immediately or without undue delay and no later than before using the item.

For transport damages, the Buyer must notify the Seller immediately or within 2 business days after receipt for the transport insurance to be applicable.

9. Warranty Terms

The warranty period starts from the Seller’s shipping date.

Unless otherwise specified, the warranty is valid for 12/24 months or according to the Seller’s supplier warranty terms.

The warranty covers material and manufacturing defects and is limited to replacement or repair at the Seller’s workshop during regular working hours.

Shipping, handling, and other costs related to warranty repairs and standard service are covered by the Buyer.

The warranty does not cover damages due to wear and tear from abnormal use.

The Seller may require the opportunity to rectify the defect.

10. Warranty Repairs

If the Buyer believes a product has defects covered under the Seller’s warranty, the Seller must be contacted to arrange collection, diagnose the issue at their workshop, inform the customer of the outcome, and agree on a resolution.

The Seller has the right to carry out repairs.

11. Transport Insurance

When SeaSpection arranges shipping to/from the customer’s address, the goods are insured on behalf of the customer. In case of damage or total loss during transport, the customer will be charged a deductible according to the insurance company’s policy.

12. Payment Terms

Invoices are due for payment 10 days after the goods are shipped from the Seller’s address or can be collected by the Buyer at the same location.

Late payments are subject to interest according to the Norwegian Act on Late Payment Interest.

13. Retention of Title

The Seller retains ownership of the goods until the full purchase amount has been paid. The Seller is free to transfer its claims.
